Terms and Conditions

These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through Transportation providers) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using woodlandstransport.com.sg and its affiliated webpage under this domain through whatever platform (hereafter referred to as the “Website”) and/or by completing a booking, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy policy).

These pages, the content and infrastructure of these pages, and the online booking service provided on these pages and through the Website are owned, operated and provided by Woodlands Transport Service Pte Ltd. and are provided for your personal use only, subject to the terms and conditions set out below.

1.    Definitions

In these terms and conditions, the following definitions and rules of interpretation apply unless otherwise defined or the context requires otherwise:

1. “Woodlands Transport”, “the Company” “us”, “we” or “our” means Woodlands Transport Service Pte Ltd, a private limited company incorporated under the laws of the Republic of Singapore, and having its registered address at 8 Gul Circle Singapore 629564, the Republic of Singapore.
   • ^{“Website” means the website on which the booking service is made available owned, controlled, managed, maintained and/or hosted by Woodlands Transport Service Pte Ltd.}
   • ^{“Service” means any and all services provided by us to you by means of your use of our website and/or any other services, which is described but not limited to in 3. Scope of service.}
   • ^{“Transportation providers” means the third party provider of transportation except Woodlands Transport.}
   •  ^{“Singapore” means the Republic of Singapore.}
   • ^{“SGD” means Singapore dollars, the lawful currency of Singapore.}
   • ^{“Terms” means these terms and conditions, which may be amended and supplemented by us from time to time in accordance with 4. Modification to terms and services.}
2. Headings are for convenience only and do not affect interpretation. The singular includes the plural and the masculine shall include the feminine and neuter and vice versa.
3. A reference to a person, corporation, trust, partnership, unincorporated body or other entity includes any of them.

2.    Representation and warranty

By using the Service, you expressly represent and warrant that you are legally entitled to accept and agree to the Terms and Conditions and that you are at least eighteen (18) years old. Without limiting the generality of the foregoing, the Service is not available to persons under the age of eighteen (18) or such persons that are forbidden for any reason whatsoever to enter into a contractual relationship. By using the Service, you further represent and warrant that you have the right, authority and capacity to use the Service and to abide by the Terms and Conditions. You further confirm that all the information which you provide shall be true and accurate. When using the Service, you agree to comply with all applicable laws whether in your home nation or otherwise in the country, state and city in which you are present while using the Service.

You may only access the Service using authorized means. It is your responsibility to check and ensure that you are using the correct Website. The Company reserves the right not to permit you to use the Service should you violate any of the policy stated in this Terms and Conditions.

By using the Website, you agree that:

• You will only use the Service for lawful purposes;
• You will only use the Service for the purpose for which it is intended to be used;
• You will not use the Website for sending or storing any unlawful material or for fraudulent purposes;
• You will not use the Website to cause nuisance, annoyance, inconvenience or make fake bookings;
• You will not use the Website for purposes other than obtaining the Service;
• You shall not contact the Transportation provider for purposes other than the Service;
• You will not impair the proper operation of the network;
• You shall not intentionally or unintentionally cause or attempt to cause damage to the Transportation provider;
• You will not try to harm the Service or the Website in any way whatsoever;
• You will not copy, or distribute the Website or other content without written permission from the Company;
• You will only use the Website for your own use and will not resell it to a third party;
• You will keep secure and confidential any identification we provide you which allows access to the Service;
• You will provide the Company with proof of identity as it may reasonably request or require;
• You agree to provide accurate, current and complete information as required for the Service and undertake the responsibility to maintain and update your information in a timely manner to keep it accurate, current and complete at all times during the term of Service. You agree that the Company may rely on your information as accurate, current and complete. You acknowledge that if your information is untrue, inaccurate, not current or incomplete in any respect, the Company has the right but not the obligation to terminate your use of the Service at any time with or without notice;
• You shall not cause a nuisance or behave in an inappropriate or disrespectful manner towards the Company or the Transportation provider regardless of any misgivings that you may have against the Company or the Transportation provider;
• You shall not impair or circumvent the proper operation of the network which the Service operates on;
• You agree that the Service is provided on a reasonable effort basis; and
• You agree that your use of the Service will be subject to the Company’s Privacy Policy as may be amended from time to time.

You agree to assume full responsibility and liability for all loss or damage suffered by yourself, the Transportation provider, the Company or any third party as a result of any breach of the Terms and Conditions.

3.    Scope of service

Through the Website, we (Woodlands Transport and its affiliated partners) provide an online platform through which we and other Transportation providers can provide transportation services, and through which visitors of the Website can make such booking (i.e. the booking of transportation service). By making a booking through the Website, you enter into a direct (legally binding) contractual relationship with the Company with which you make a reservation of service.

The Service shall include the provision of a vehicle of the stipulated capacity with driver for the carriage of passengers.

The Service shall not include:

• The fulfilment of the purpose of the journey.
• The supervision of passengers, in particular children, adolescents and persons in need of assistance.
• The supervision of items which you or other passengers leave behind on the vehicle.
• The supervision of items during loading and unloading the vehicle, the information about the regulations relevant for all passengers, as in particular foreign exchange, passport, visa, customs and health regulations, and the compliance with these regulations, unless otherwise expressly stated.

When rendering our Service, the information that we disclose is based on the information gathered by us from you and our Transportation providers, and is accurate at the time of disclose only.

Our Service is made available for personal use only. Therefore, you are not allowed to re-sell, download or reproduce any content or information, reservations, or services available on our Website for any commercial or competitive activity or purpose.

4.    Modification to terms and services

The Company shall be entitled to amend or modify the scope of services at any given time with or without prior notice, if the circumstances that necessitate the modification are not caused by the Company in bad faith. The Company, with reasonable effort, will inform you about the change and the reason for changes, to which the amended or modified scope of services shall be effective and binding on you immediately upon notification.

Amendment or modification in the scope of services by you shall only be permitted upon the approval by the Company. It must be made either in writing or agreed via e­mail unless otherwise agreed by the Company.

The Company shall be entitled to amend or modify this Terms and Conditions at any given time with or without prior notice, to which the amended or modified terms will be effective and binding immediately at the moment of publish on the Website. The Company will also include the amended or modified terms under the revision history for easier viewing.

5.    Payment, cancellation and refund

It is free to browse or use the Website for the purpose of making a booking for transportation through us.

By making a booking with us or our Transportation providers, you accept and agree to the relevant payment, cancellation and refund policy as stated in this Terms and Conditions, and to any additional terms and conditions of the third party which facilitates other functions through the Website and is part of the overall service provided.

• All prices shown are in SGD.
• The price shown in the confirmation page on the Website shall be binding.
• Additional costs caused by amending or modifying the services on request of the passenger shall be charged in addition.
• The costs incurred as a result of damage to the vehicle or clean up or fines and penalties caused by the passenger shall be charged in addition on reasonable or legal grounds, unless otherwise agreed by the Company or its Transportation providers.
• Invoices shall be payable upon receipt without deduction.
• The Company shall be entitled to demand a full prepayment, if the booking party is a private person or a foreign business entity.

The general cancellation and refund policy is as follows.

• Should the transportation service not be utilised after the vehicle leaves the depot for any reason whatsoever then this shall be considered as a completed service.
• If the passenger fails to board the vehicle at the designated time and location after reasonable effort has been given by the Company or its Transportation provider, then this shall be considered as a completed service.
• You must notify the Company of cancellations via writing or email. There is a 50% cancellation fee if the cancellation is made prior to 3 working days once a booking has been confirmed.
• In the circumstances of the Company not able to fulfil a confirmed booking, or part thereof, the Company will only be liable to refund to you the portion of the charges that relates to the non-fulfilment part of the confirmed booking, and is not liable for loss of money paid for additional or separate services and products that have been missed or forfeited due to the non-fulfilment.
• Special rates and offers are not eligible for cancellation or change.
• Please check the (booking) details of your service of choice thoroughly for any such conditions prior to making your booking. A confirmed booking amended or cancelled by you will not be refunded unless otherwise approved by the Company.
• Similarly, a booking which requires down payment or (wholly or partly) prepayment will not be refunded if amended or cancelled by you or in a case of no-show.
• Late payment, wrong bank details, or any other errors made by you during the payment process shall not be subjected to any refund unless the Company agrees or expressly stated otherwise.

6.    Privacy policy

We, Woodlands Transport Services Pte Ltd and its affiliates (together “Woodlands Transport” or the “Company”), recognizes the importance of protecting the privacy and security of your personal information. In order of protecting your personal information, we have established this Privacy Policy (the “Policy”) in accordance with best practices in the industry and in compliance with the Singapore Personal Data Protection Act 2012 (No. 26 of 2012). This Policy describes how we handle your personal information for our services on the t3airportshuttle.com.sg website and its related sites, services and tools (the “Website”).

We may update this Privacy Policy from time to time.  You agree to be bound by the prevailing terms of this Privacy Policy as updated from time to time.  We encourage you to check the latest version of this Privacy Policy regularly.

Furthermore, by booking our services through the Website, you expressly consent to our collection, storage, use and disclosure of your personal information as described in this Policy.

Collection of your personal information

You can browse our sites without revealing any personal information about yourself. Once you give us your personal information, you are not anonymous to us. If you choose to provide us with personal information, you consent to the transfer and storage of that information on our servers located in the Republic of Singapore.

We may collect and store the following personal information:

• Legal name, email address, physical contact information, the country of birth and gender information, nationality, passport and other legal documents information relating to you which you have provided in any forms you may have submitted to use, or in other forms of interaction with you;
• Transactional information based on your activities on the Website (such as submitting a booking, and making payments);
• Postage, billing and other information you provide to book for our services;
• Discussions, chats, dispute resolution, and correspondence sent to us via postage or email;
• Other information from your interaction with our Website and services, including computer and connection information, statistics on page views, traffic to and from the Website, IP address and standard web log information;
• Additional information we ask you to submit to authenticate yourself or if we believe you are violating our policies (for example, we may ask you to send us an ID or bill to verify you’re your payments, or to answer additional questions to help verify your identity or ownership of a service booked);
• Other supplemental information from third parties.

Marketing of your personal information

We don’t sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve our services.

Use of your personal information

Our primary purpose in collecting personal information is to provide you with a safe, smooth, efficient and customized experience. You agree that we may use your personal information to:

• To verify your identity;
• To provide the services and customer support;
• To notify you of changes on your booking or to respond to any communication from you
• To investigate and resolve disputes
• To collect payments;
• To prevent potentially prohibited or illegal activities, and enforce our Terms & Conditions;
• To measure and improve our services;
• To keep you updated about our services and products;
• To compare information for accuracy, and verify it with third parties.

Disclosure of your personal information

We may disclose personal information to respond to legal requirements, enforce our policies, or protect anyone’s rights, property, or safety. Such information will be disclosed in accordance with applicable laws and regulations.

Share of your personal information

We may share your personal information with:

– Third-party service providers under contract who help with our business operations: We employ other business entities and individuals to perform functions on our behalf. Examples include fulfilling bookings, sending postal mail and e-mail, analyzing data, providing marketing assistance, processing payments, investigating frauds and providing customer service. They have access to personal information needed to perform their functions, but may not use it for any other purposes.

– Other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service).

– Law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal activity. In such events, we will disclose information relevant to the investigation, such as name, passport number, employer name, city, postal code, telephone number, email address, IP address, booking details and booking history; and

– Other business entities, should we plan to merge with or be acquired by that business entity. (Should such a combination occur, we will require that the new combined entity follow this privacy policy with respect to your personal information. If your personal information will be used contrary to this policy, you will receive prior notice.)

For the avoidance of doubt, If Woodlands Transport has reasonable grounds to believe that any customer is in breach of any of the terms of this Policy, Woodlands Transport reserves the right, in its sole and absolute discretion, to cooperate fully with governmental authorities, private investigators, all the rightful owner(s) or interest holder(s) and/or injured third parties in the investigation of any potential or ongoing criminal or civil wrongdoing. Further, Woodlands Transport may disclose the customer’s identify and contact information, or such other transaction-related data, if requested by a government or law enforcement body, private investigator, rightful owner or interest holder and/or any injured third party or as a result of a subpoena or other legal action, or if Woodlands Transport is of the view, in its sole and absolute discretion, that it would be in its best interest to do so. Woodlands Transport shall not be liable for damages or results arising from such disclosure, and the customer(s) agrees not to bring action or claim against Woodlands Transport for such disclosure.

Protect your personal information

If you access our Website from a shared computer or a computer in a public place such as a PC room or a library, certain information about you may also be visible to other individuals who use the computer after you. To protect your personal information from being disclosed to others, you should close the web browser after using our Website.

Security of your personal information

Your information is stored on our servers located in the Republic of Singapore. We will endeavour to protect your personal information in our possession or control against risks of unauthorised access, collection, use, disclosure, copying, modification, disposal or destruction, through reasonable and appropriate security measures. We ensure that our systems are secure and that they meet industry standards. However you do acknowledge that no data transmission over the internet is completely safe and secure and by providing your personal information over the internet, you are transmitting information at your own risk.

Third party

Except as otherwise expressly included in this Policy, this document addresses only the use and disclosure of information we collect from you. If you disclose your information to others, whether they are third-party service provider on our Website or other sites throughout the Internet, different rules may apply to their use or disclosure of the information you disclose to them. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.

7.    Laws and regulations

These Terms shall be governed by and construed in accordance with the laws of Singapore. Both you and the Company agree to submit to the exclusive jurisdiction of the courts of Singapore as regards any dispute or matter arising under these Terms.
